Legal Seminar Brochures Mailed

On May 20, 2005, NOLHGA mailed brochures with program and registration information for the 13th Annual Legal Seminar. The seminar will be held in Park City, Utah on August 18-19, 2005, and an MPC Meeting will be held in conjunction with the seminar on August 16-17th. The seminar features presentations focused on a wide range of guaranty association and receivership issues including regulatory reform from both federal and state perspectives, the Spitzer investigations, insurance runoff plans, litigation issues and fraud claims. NOLHGA is in the process of applying for CLE credit in all states that require CLE. Credit for insurance department continuing education has also been granted in the past on an individual basis. The deadline for both meeting and hotel registration is July 25th. NAIC’s Receivership and Insolvency Task Force Recommends New Receivership Model

During a four hour teleconference on Wednesday, May 18, the NAIC’s Receivership and Insolvency Task Force reviewed and approved a proposed new receivership model law, the draft of which was released by the NAIC’s Model Act Revisions Drafting Group on Monday, April 25. Following discussion and debate, the proposed model was approved by the Task Force, with amendments, by a vote of 14 to 2. The Task Force is expected to present the proposed model to the NAIC’s E-Committee with a recommendation for approval in conjunction with the June NAIC meeting. Although the details concerning scheduling are not yet available, NAIC staff counsel has advised that E-Committee will hold a one to one and a half hour hearing to consider the model at the June meeting. More information concerning the scheduling of the hearing on the model will be provided as that information becomes available. Given the comprehensive nature of the changes made to this model, and the fact that the NAIC intends this new receivership model to serve as an accreditation standard for the states, interested parties are encouraged to review the revised draft and provide any input or comments they may have.
