Notice of Appeal Filed by Attorney Edward Stone
Attorney Edward Stone, who represents a number of ELNY payees, announced yesterday that he had filed a Notice of Appeal of Judge Galasso's April 16 Decision and Order of Liquidation. One of the various grounds for appeal attributed to Stone is his continuing claim that the Agreement of Restructuring creates impermissible sub-classes of ELNY payees. Counsel for the New York guaranty association has obtained what purports to be Stone's Notice of Appeal, and NOLHGA's working group will be confirming whether the Notice of Appeal has been filed and coordinating with the New York Liquidation Bureau on the appropriate course of action.

NOLHGA's 2012 Legal Seminar will feature the Honorable David M. Walker, founder and CEO of the Comeback America Initiative (CAI) and former Comptroller General of the U.S., as its keynote speaker during lunch on July 26.
At CAI, Walker leads the effort to promote fiscal responsibility and sustainability by engaging the public and assisting key policymakers on a nonpartisan basis to help achieve solutions to America's federal, state, and local fiscal imbalances. Prior to assuming his current position, he served as the first President and CEO of the Peter G. Peterson Foundation. In addition, Walker was appointed as the seventh Comptroller General of the United States and head of the U.S. Government Accountability Office (GAO) for almost 10 years (1998-2008). This was one of his three presidential appointments, each by different Presidents, during his 15 years of total federal service.
NOLHGA's 20th Annual Legal Seminar is scheduled to take place on July 26-27, 2012, at the Fairmont Copley Plaza in Boston. Staff Contact - Executive Life Insurance Company (California)Trial Date Set in Artemis Case
On May 29, 2012, U.S. District Court Judge R. Gary Klausner met with the parties for a "Trial Setting Conference" in Los Angeles. The judge set the trial to begin on October 23, 2012. While the judge did not set trial limits, he did indicate that he thought the trial should take three to four days.
In addition, the judge set the following deadlines for motions and pretrial matters. Motions in Limine must be filed by July 12, are limited to five pages, and will be fully briefed by August 2. A joint statement of facts, to be agreed upon by the parties, may be filed jointly by the parties no later than August 1. The court will determine whether portions of this filing will be included in the court's statement of facts, which will be read to the jury. A pretrial hearing will be held on October 1 at 9:00 a.m.
