MPC Meets in New York

The Members’ Participation Council (MPC) met in New York City on July 18, 2018. The Penn Treaty Network America/American Network Insurance Companies (Pennsylvania) Task Force conducted a closed-session presentation, and a Lessons Learned Workshop on older insolvencies was conducted by Pamela Olsen (MPC Chair), Jan Funk (Indiana), John Colpean (Michigan), and William Falck (Florida). The MPC Executive Committee also met.

In addition to the task force reports below, the MPC General Session featured updates on the activities of the HMO Orientation Materials Subgroup (by Chair Lee Douglass (Arkansas)), Model Plan of Operations Subgroup (by Chair Margaret Sperry (Rhode Island)), Coverage/Claims Committee (by Chair John Colpean (Michigan)), and GA Laws Committee (by Staff Contact Bill O’Sullivan). Steve McBrady (Crowell & Moring) presented an overview of the status of ACA risk corridor and reinsurance litigation, NOLHGA President Peter Gallanis provided the President’s Report, and MPC Chair Pamela Olsen briefed attendees on MPC Executive Committee activity.

Task Force Chair Bart Boles (Texas) provided an overview of the two companies, which have approximately 9,000 policyholders. While both companies are P&C companies, they wrote primarily long-term-care business. The task force is waiting to obtain additional financial information on the companies.

Task Force Chair Tom Peterson (Kentucky) updated attendees on the status of this 2010 receivership. The task force expects a distribution later this year, and the receiver hopes to close the estate in 2019.

Task Force Chair Tad Rhodes (Colorado and Oklahoma) briefed attendees on the remaining blocks of business, two of which could be assumed at a later date. As a result of the Appellate Court’s original trial ruling, the new trial is scheduled to begin in late November.
