Ninth Circuit Rules for NOLHGA in Watson Case
On January 3, 2008, the United States Ninth Circuit Court of Appeals affirmed the district court's dismissal of the case filed by the guardians of policyholder Kathleen Watson together with four other policyholders. The policyholders asserted various claims against NOLHGA related to the dispute over the participating guaranty association distribution rights. The appellate court concluded that the policyholders lacked standing to bring their action based on California law, which grants the insurance commissioner, as trustee of the ELIC estate, the exclusive power to prosecute and defend lawsuits as well as dispose of estate assets. Having reached its decision based on lack of standing, the appellate court declined to rule on defenses of 12(b)(6) and mootness.
Task Force Chair - Art Dummer; Staff Contact -Administrators Asked to Register for Technology Seminar
The Administrators' Education Steering Committee will be sponsoring a technology seminar at the January 2008 MPC meeting in Phoenix. The seminar, which is currently scheduled for January 29 from 9:30 a.m. to 11:00 a.m., will focus on Microsoft Word 2003 and Microsoft Excel 2003.
The segment on Microsoft Word will address topics such as understanding "Track Changes," working with Word charts, creating Word tables, and using the "Sort" functions. The Excel segment will cover sorting and subtotaling; how to modify your "Print" options; using formulas and the Formula bar; inserting rows and columns; freezing screens, split screens, and hiding columns; using Copy and Paste (numbers and formulas); and basic charts and graphing.
Guaranty association administrators who would like to attend the seminar should register with Holly Wilding by January 21. Please contact Holly if you have any questions.
