Deputy Receiver Sends Notices of Determination

On January 31, 2008, the deputy receiver for the Consumers United estate mailed a Notice of Determination to each affected state guaranty association outlining the estate's position regarding policyholder-level claims and guaranty association expenses. Some unaffected states also received a Notice of Determination in error. The notice indicates that a guaranty association may object to the determination by sending a written objection to the deputy receiver that must be received within 60 days of the date of the notice mailing (the deadline is March 31, 2008). In most insolvencies, the guaranty associations typically file their objections individually. Please notify Meg Melusen at NOLHGA if you intend to object.

Expense Reporting for Final Proof of Claim Due

The task force is in the process of preparing a final update to the guaranty associations' Omnibus Proof of Claim in the SGLIC insolvency. The final update will reflect guaranty association claims and expenses incurred through December 31, 2007. Accordingly, affected associations are asked to submit updated expense information for inception through year-end 2007 using NOLHGA's online Proof of Claims Survey.
