
Annual Meeting Registration Begins
Registration forms for “The Direction of Change,” NOLHGA’s 19th Annual Meeting, are now being accepted. The meeting will be held October 31 and November 1, 2002, at the Monarch Hotel in Washington, D.C. (an MPC meeting will take place October 30), and anyone planning to attend can fill out and print a registration form on the Annual Meeting Web page; a registration packet was also mailed out in early August.
If you have registered for the meeting at the meeting Web page, please remember to mail your completed registration form with payment to: NOLHGA Annual Meeting, 13873 Park Center Road, Suite 329, Herndon, VA 20171. Registration is not official until the NOLHGA office receives a completed form with payment. The following are summaries of task force insolvency reports presented during the Members’ Participation Council meeting held August 14 in Chicago.
Staff Contact - Sean McKenna American Chambers Life Insurance Company (Ohio)Task Force Chair Chuck Gullickson (S.Dak.) updated meeting attendees on the task force’s asset recovery efforts and the Lessons Learned Report. The liquidator’s counsel filed a complaint against American Chambers’s officers and directors in early May, and the estate is also responding to claims submitted by two insurers who reinsured their health policies with American Chambers. Bart Boles (Tex.) briefed attendees on the efforts of LaShelle, Coffman & Boles in archiving eligibility data for the affected guaranty associations; the firm hopes to mail CDs with the data to associations in late August and will begin forwarding claims to the associations in September.
Task Force Chair - Chuck Gullickson; Staff Contact - Bankers Commercial Life Insurance Company (Tex.)Paul Peterson (NOLHGA staff) provided an overview of the proposed assumption reinsurance agreement with New Era, and the MPC approved a resolution authorizing the BCL task force to complete negotiations on the agreement. Task Force Legal Counsel Frank O’Loughlin (Rothgerber, Johnson & Lyons) briefed attendees on agreements concerning the administrative expense/premium offset issue in BCL and four other Texas-domiciled insolvencies.
Task Force Chair - William Falck; Staff Contact - Paul Peterson Inter-American Life Insurance Company (Ill.)Task Force Chair William Falck (Fla.) reported that the appeal in the Employer’s Re litigation was settled in favor of the Office of the Special Deputy Receiver (OSD) for $12 million. The OSD is expected to make a distribution by year-end or early in 2003.
Task Force Chair - William Falck; Staff Contact - Joni Forsythe National Heritage Life Insurance Company (Del.)Task Force Chair Dan Orth (Ill.) updated attendees on the status of Sholam Weiss, who was recently extradited to the United States from Austria.
Task Force Chair - Dan Orth; Staff Contact - The Thunor Trust CompaniesTask Force Chair John Colpean (Mich.) reviewed the assets and liabilities of five of the Thunor Trust companies and reported that an early access distribution is unlikely in the near future. Task Force Legal Counsel Charlie Richardson (Baker & Daniels) gave an overview of the asset recovery efforts and litigation concerning the estate, including a confidentiality agreement affecting possible settlements between the receivers and third parties. The MPC approved a resolution adopting the task force’s recommendation that NOLHGA enter into the confidentiality agreement so that the task force can be kept advised of these settlements.
Task Force Chair - John Colpean; Staff Contact -MPC Executive Committee Report
MPC Executive Committee Chair William Falck (Fla.) updated attendees on Executive Committee activities. The TPA Committee, which is investigating ways to implement the recommendations made in last year’s Health Insurance Issues Committee report, plans to send a letter to guaranty associations seeking their input on a number of issues. The Model Plan of Operations subgroup is still receiving operations plans from associations, and Falck urged any association that has not yet submitted its plan to do so. He also reported that the MPC Chair Selection Committee will send his name and the names of Jack Falkenbach (Del.) and Mike Marchman (Ga.) to the NOLHGA Chair for consideration as the next chair of the MPC.
