Delaware Enacts Fabe Cure Legislation
On July 6, 2000, Delaware Governor Carper signed into law Senate Bill 352 modifying the priority provisions of Delaware's rehabilitation and liquidation act. The stated purpose of the modifications is to conform Delaware's priority statute with the holding of the United States Supreme Court in the case of U.S. Dept. of Treasury v. Fabe, and to further clarify the priority of distribution of general assets from the estate of an insolvent insurer.
