Weiss Appeal Denied
On September 24, 2013, the United States Court of Appeals for the Eleventh Circuit upheld the convictions of former fugitive Sholam Weiss on 78 counts of racketeering, wire fraud, interstate transportation of stolen funds, money laundering, and other offenses. During his 1999 criminal trial, Weiss fled the country and was sentenced in his absence to serve 845 years in prison and pay $123,399,910 in fines and $125,016,656 in restitution for the crimes arising from his participation in a scheme to defraud National Heritage Life Insurance Company. Law enforcement officers eventually found Weiss living in Austria, and he was extradited to the United States in 2002.
Eventually, the district court vacated the conviction on one count of obstruction of justice and reduced Weiss’s sentence to 835 years, in compliance with the terms of the extradition. In his 2013 appeal to vacate the convictions on the remaining counts, Weiss challenged the original jury instructions and also argued his attorney should have been disqualified from representing him because prosecutors had served the attorney with a subpoena. The Court of Appeals rejected these arguments and upheld the convictions.

The 2012 Assessment Data Survey information has been posted on Quest, NOLHGA’s secure insolvency library. The premium data available for download is a compilation of assessable premium for companies that are licensed in each state. The data is calculated using the information reported on the Life, Health & Annuity Guaranty Association Model Act Assessment Base Reconciliation Exhibit and the Adjustments to the Life, Health & Annuity Guaranty Association Model Act Assessment Base Reconciliation Exhibit. The data files provided on Quest (which can be accessed by authorized users after logging into the NOLHGA Web site) are similar to those sent in past years.
A letter has been sent to all state insurance commissioners informing them the survey data is available from Strohm Ballweg if they would like a copy of the data for their state.
