MPC Meets in New York

The Members’ Participation Council (MPC) met in New York City on July 15 and 16, 2014. The Penn Treaty Network America/American Network Insurance Companies (Pennsylvania) task force conducted a presentation to affected guaranty associations, and the meeting also featured meetings of the MPC Executive Committee and the committee’s Insolvency Resource Guide Subgroup.

In addition to the task force reports below, the General Session featured an update on the activities of the Coverage/Claims Committee by Committee Chair John Colpean (Michigan) and committee members Art Dummer (Utah), Margaret Sperry (Rhode Island), Kevin Griffith (Faegre Baker Daniels), and Bill O’Sullivan (NOLHGA). MPC Chair John Colpean briefed attendees on MPC Executive Committee activity.

ELNY Task Force Chair and GABC Board Member Jack Falkenbach (Delaware) reviewed GABC’s 2014 to-date financials and reported that the final Schedule 1.15 had been posted on the GABC website (www.gabenefitsco.com). Legal Counsel Kevin Griffith (Faegre Baker Daniels) reported that two new class-action suits have been filed in the ELNY matter, though GABC was not named as a defendant in either suit.

Task Force Chair Mike Marchman (Georgia) reported that claims filing and funding began in May 2014, and that the guaranty associations filed their omnibus proof of claims in June. The task force plans to negotiate an early access agreement with the Florida Department of Financial Services and is considering conducting a review of TPA claims processing later this year.

Task Force Legal Counsel Joel Glover (Lewis Roca Rothgerber) briefed attendees on a proposed resolution authorizing the task force to enter into an administrative agreement with Insurance Administrative Solutions, LLC (IAS). The resolution was passed unanimously.
