Kentucky Court Clarifies Decision Regarding Premium Taxes
As reported in the August 13, 2004, issue of the NOLHGA Wire, the Kentucky liquidation court issued an order on August 5 directing the Kentucky Central liquidator to pay the Connecticut Department of Revenue's claim for premium taxes, including certain taxes that accrued after the date of liquidation, as a Class One distribution. By order dated September 13, the liquidation court amended its ruling in this matter to clarify that, under Kentucky law, premiums paid on policies after the date of liquidation generally belong to and shall be payable at the direction of the affected state life and health insurance guaranty associations. However, as the court explained, the facts presented in this case were unique and peculiar in that the liquidation court had specifically ordered the estate to keep all life, health, and annuity policies of Kentucky Central in force, after the date of the liquidation order, and until such time as the assumption reinsurance plan with the assuming carrier could be implemented. Accordingly, the court found that premium payments paid to Kentucky Central in order to continue those policies in force for the term specified after the date of the liquidation order subjected the estate to premium taxes that were to be paid as an estate administrative expense. A revised schedule for NOLHGA's 21st Annual Meeting, which will be held October 26-27, 2004, at the Four Seasons Las Vegas in Las Vegas, Nev., is now available on the meeting Web page, which can be found here. A PDF file of the schedule can be found in the "Meeting Resources" section.
The Web page also features hotel and reservation information, speaker biographies, MPC meeting information (see below), and online meeting registration. As a new feature this year, the Web page allows users to pay their registration fees online through NOLHGA's secure online payment system, which accepts Visa and MasterCard. Attendees who wish to pay by check can still register online. Once they have completed the registration form, they can simply print a copy and mail it with a check to NOLHGA.
The cut-off date for hotel reservations is September 30, and the registration deadline for the Annual Meeting and MPC meeting is October 4. If you have not yet made your reservations or registered for the meetings, we urge you to do so as soon as possible.

A preliminary schedule for the October 25, 2004, MPC meeting, which will be held at the Four Seasons Hotel Las Vegas in Las Vegas, Nev., has been posted on the Web page the meeting shares with NOLHGA's 21st Annual Meeting, which can be found here. The schedule, which is in PDF format, can be found in the "Meeting Resources" section.
Tentatively, task force and committee meetings will be scheduled throughout the day, and the general session will take place in the early afternoon. The briefing book for the meeting should be available in early October.
