In an Order dated September 2, 2010, the Circuit Court of the 19th Judicial Circuit in and for Martin County, Florida (Case No. 03-258 CA) (the “Florida Court”) denied a motion by class-action plaintiffs to join the Florida Life & Health Insurance Guaranty Association as a party defendant. The suit was originally brought against Medical Savings Insurance Company (“MSIC”), an Indiana-domiciled insurer that was subsequently placed into liquidation in February 2009.
In the order, the Florida Court ruled that, while it had determined that MSIC breached the insurance certificates, it had not entered judgment against MSIC prior to its liquidation. The Florida Court recognized that the Indiana Liquidation Court “is overseeing the liquidation of Medical Savings Insurance Company, which includes overseeing claims made by all Medical Savings Insurance Company's insureds.” The Florida Court noted that Indiana and Florida were considered reciprocal states under the Uniform Insurers Liquidation Act. Specifically, the Florida Court found “that a granting of the Motion, without the approval of the Indiana Court overseeing the Indiana Liquidation Litigation, would violate the meaning and intent of the Liquidation Order which deserves comity by this Court.”
