NAIC Updates

On August 21, 2026, the RBC Investment Risk and Evaluation Working Group exposed a portion of the American Academy of Actuaries’ previous presentation on collateralized loan obligation (CLO) C-1 factors via email. The presentation focused on sensitivity tests for several key modeling assumptions in its CLO framework. Based on stakeholder feedback, the working group is soliciting feedback on the following:

  • Whether stakeholders support the continued refinement of the following assumptions: (1) Systemic Risk Correlation, (2) Recovery Average, and (3) Collateral Repurchase Price and Prepayment.
  • If supportive, are there recommendations for refinements (with empirical support)?

Details surrounding these assumptions are available here. Comments are due by September 4.

International Developments

On August 14, 2026, the Bermuda Monetary Authority (BMA) published a Consultation Paper and draft Guidance Note on the responsible use of AI across its regulated financial services sector for comment through October 30. The Consultation Paper builds on the BMA’s July 2025 Discussion Paper on the same topic, which detailed the BMA’s preliminary thinking and sought stakeholder feedback on potential regulatory pathways. This consultation represents the next phase of the regulatory process; it contains a draft Guidance Note and describes how Discussion Paper feedback shaped the BMA’s approach. Stakeholders broadly supported a principles-based, proportionate approach integrated into existing frameworks, while requesting clarity on how current regulatory requirements apply to AI and cautioning against rigid rules ill-suited to Bermuda’s market.

The proposed Guidance Note is designed to be principles-based and proportionate, organized around five outcomes:

  • Accountable governance
  • Lifecycle management
  • Reliable and explainable AI outcomes
  • Secure deployment
  • Adequate supervisory evidence

The Note does not create new statutory obligations or a separate AI approval regime but instead clarifies how existing frameworks apply. Governance intensity scales with the materiality and risk of the AI use case rather than entity size or technology label, and the approach is calibrated to Bermuda’s international and wholesale market. The Note includes dedicated sections on generative AI and agentic AI risks, addresses shadow AI as a growing governance challenge, and maintains clear accountability for regulated entities even when AI is outsourced. Following the consultation period, the BMA will refine the Guidance Note before issuing a final version and may develop supplementary sector-specific materials.

The National Institute of Standards and Technology (NIST) published a concept paper titled Human-Centered Cybersecurity Guidelines and Resources. The paper is intended to introduce NIST’s goal to publish guidelines and resources to assist organizations and professionals in addressing the human aspects of cybersecurity, referred to as “human-centered cybersecurity.” The goal of human-centered cybersecurity is to improve cybersecurity outcomes by putting people and their needs, abilities, and limitations at the forefront when designing, implementing, and making decisions about cybersecurity policies, processes, technologies, and services. In connection with the publication, NIST is accepting comments on the concept paper through September 30, 2026.
